These Terms of Service (“Terms”) govern your access to and use of the website https://sivali.us(the “Site”) and any products, services, or content offered by Sivali Inc. (“Sivali,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of forming a binding contract to use the Site or make a purchase. By using the Site, you represent that you meet these requirements.

2. Account Registration

You may need to create an account to access certain features. You agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Products and Automotive Parts

Fitment and compatibility. We sell automotive parts and accessories. Part compatibility depends on your specific vehicle make, model, year, trim, and configuration. You are responsible for confirming that a part fits your vehicle before purchase, including verifying part numbers and specifications. Fitment tools, descriptions, and cross-reference data are provided for convenience and are not guaranteed to be error-free.

Installation. Products may require professional installation. Improper installation or use may cause damage, injury, or void manufacturer warranties. We are not responsible for installation, labor costs, or any damages resulting from installation or use of products.

Aftermarket and OEM parts. Unless expressly stated, parts may be aftermarket rather than original equipment manufacturer (OEM) parts. References to vehicle brands, models, or part numbers are for identification and compatibility purposes only and do not imply affiliation with or endorsement by any vehicle manufacturer.

4. Product Descriptions and Pricing

We strive for accuracy but do not warrant that product descriptions, images, pricing, or other content are complete, current, or error-free. We reserve the right to correct errors and to change prices, descriptions, and availability at any time without notice. Colors and appearance may vary from images shown.

If a product is listed at an incorrect price or with incorrect information, we may cancel or refuse any order placed for that product, even after order confirmation, and will refund any amount charged.

5. Orders and Acceptance

Your order constitutes an offer to purchase. All orders are subject to our acceptance. We may refuse, limit, or cancel any order for any reason, including suspected fraud, ordering errors, product unavailability, or limits on quantities. Order confirmation does not guarantee acceptance. We may require additional verification before accepting an order.

6. Payment

You agree to pay all charges, applicable taxes, and shipping fees for your orders. Payment is processed through third-party payment processors. You represent that you are authorized to use the payment method provided. We reserve the right to refuse or cancel transactions that fail verification or appear fraudulent.

7. Shipping and Delivery

Shipping times and costs are estimates and may vary. Risk of loss and title pass to you upon delivery to the carrier, unless otherwise required by law. We are not responsible for delays caused by carriers, customs, or events beyond our control. You are responsible for any customs duties, import taxes, or fees for international shipments.

8. Returns, Refunds, and Warranties

Returns and refunds are governed by our Return Policy, which is incorporated into these Terms. Certain items, including electrical parts, special orders, and installed parts, may be non-returnable. To be eligible, items generally must be unused, in original packaging, and returned within the stated return window.

Manufacturer warranties. Products may carry manufacturer warranties. Any such warranties are provided by the manufacturer, not Sivali, and are subject to the manufacturer’s terms. We do not provide additional warranties except as required by law.

9. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that products will meet your requirements.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SIVALI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR VEHICLE DAMAGE, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so these may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Sivali and its affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Intellectual Property

The Site and its content, including text, graphics, logos, the Sivali name and brand, images, and software, are owned by or licensed to Sivali and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission. Third-party trademarks and part numbers remain the property of their respective owners.

13. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful or fraudulent purpose.
  • Interfere with or disrupt the Site’s operation or security.
  • Attempt to gain unauthorized access to any systems or accounts.
  • Use automated means (bots, scrapers) to access the Site without permission.

19. Severability and Entire Agreement
